Kerry gives farewell speech to Senate

Choking up twice during a farewell speech on the Senate floor, Sen. John Kerry delivered a dissenting opinion about Washington's so-called dysfunction days before taking over as the next secretary of state.

"On occasion, we have all heard a senator leave here and take their leave condemning the Senate for being broken, for having become an impossible setting in which to try to do the people's business," said Kerry, D-Mass. "I do not believe the Senate is broken, certainly not as an institution. There's nothing wrong with the Senate that can't be fixed by what's right about the Senate."

Kerry, a 29-year Senate veteran, admitted that when he first came to the Senate in 1985 everything seemed to work easier. These days, he said, part of the problem on Capitol Hill is a lack of "courage" from individual senators.

"If the Senate favors inaction over courage and gimmicks over common ground, the risk is not that we will fail to move forward," he said. "It is that we will fall behind, we will stay behind and we will surrender our promise."

But the senator, 69, said those problems are not insurmountable, avoiding casting the whole Senate as a body paralyzed by dysfunction like so many of other departing senators have done recently.

If anything, Kerry said he believes the spirit of the Senate is starting to turn around.

"There are new whispers of desire for progress, rumors of new coalitions and a sense of possibility, whether it is on energy or immigration," he said. "I am deeply impressed by a new generation of senators who seem to have come here determined not to give in to the cynicism but to get the people's business done."

Kerry called on his colleagues, many of whom were sitting at their desks on the Senate floor to watch his speech, to make the change within themselves in the bitter debates that are ahead for the Senate.

"Only senators, one by one in their own hearts, can change the approach to legislating," Kerry said. "The Senate cannot break unless we let it."

During his tenure in the Senate, Kerry, a decorated Vietnam veteran, rose to chairman of the powerful Senate Foreign Relations Committee. His legislative and international affairs victories included the 2010 U.S.-Russia treaty, his early work on the Iran-Contra scandal and veteran's affairs.

He noted that during his time in the Senate, huge strides were made on turning a page on gay rights, a reflection of how the body can change and develop over time.

"In 1993, I testified before Storm Thurmond's armed services committee pushing to lift the ban on gays serving in the military," he said. "And I ran into a world of misperceptions. I thought I was on a 'Saturday Night Live' skit. Today, at last, that policy is gone forever and we are a country that honors the commitment of all willing to fight and die for our country. We've gone from a Senate that passed DOMA over my objections to one that just welcomed its first openly gay senator. "

After a farewell tour of Massachusetts Thursday, Kerry will be sworn in as the next secretary of state on Friday afternoon in a private, small ceremony at the State Department, replacing Hillary Clinton.

As he prepares for his diplomatic post, Kerry said that he's aware that his credibility and the country's credibility are determined by what happens in Washington.

"If we use the time to posture politically in Washington, we weaken our position across the world," he said. "If democracy deadlocks here, we raise doubts about the democracy everywhere."

The senator - who was the 2004 Democratic nominee for president - joked that this was not the original track that he'd envisioned for leaving the Senate.

"Eight years ago, I admit that I had a very different plan, slightly different, anyway, to leave the Senate - but 61 million Americans voted that they wanted me to stay here with you," Kerry said. "I learned that sometimes the greatest lesson in life comes not from victory but from dusting yourself off after a defeat and starting over when you get knocked down."

Kerry is the 10th-most-senior senator and the second-longest-serving senator in his seat.

In-brain monitoring shows memory network

Jan. 29, 2013 ? Working with patients with electrodes implanted in their brains, researchers at the University of California, Davis, and The University of Texas Health Science Center at Houston (UTHealth) have shown for the first time that areas of the brain work together at the same time to recall memories. The unique approach promises new insights into how we remember details of time and place.

"Previous work has focused on one region of the brain at a time," said Arne Ekstrom, assistant professor at the UC Davis Center for Neuroscience. "Our results show that memory recall involves simultaneous activity across brain regions." Ekstrom is senior author of a paper describing the work published Jan. 27 in the journal Nature Neuroscience.

Ekstrom and UC Davis graduate student Andrew Watrous worked with patients being treated for a severe seizure condition by neurosurgeon Dr. Nitin Tandon and his UTHealth colleagues.

To pinpoint the origin of the seizures in these patients, Tandon and his team place electrodes on the patient's brain inside the skull. The electrodes remain in place for one to two weeks for monitoring.

Six such patients volunteered for Ekstrom and Watrous' study while the electrodes were in place. Using a laptop computer, the patients learned to navigate a route through a virtual streetscape, picking up passengers and taking them to specific places. Later, they were asked to recall the routes from memory.

Correct memory recall was associated with increased activity across multiple connected brain regions at the same time, Ekstrom said, rather than activity in one region followed by another.

However, the analysis did show that the medial temporal lobe is an important hub of the memory network, confirming earlier studies, he said.

Intriguingly, memories of time and of place were associated with different frequencies of brain activity across the network. For example, recalling, "What shop is next to the donut shop?" set off a different frequency of activity from recalling "Where was I at 11 a.m.?"

Using different frequencies could explain how the brain codes and recalls elements of past events such as time and location at the same time, Ekstrom said.

"Just as cell phones and wireless devices work at different radio frequencies for different information, the brain resonates at different frequencies for spatial and temporal information," he said.

The researchers hope to explore further how the brain codes information in future work.

The neuroscientists analyzed their results with graph theory, a new technique that is being used for studying networks, ranging from social media connections to airline schedules.

"Previously, we didn't have enough data from different brain regions to use graph theory. This combination of multiple readings during memory retrieval and graph theory is unique," Ekstrom said.

Placing electrodes inside the skull provides clearer resolution of electrical signals than external electrodes, making the data invaluable for the study of cognitive functions, Tandon said. "This work has yielded important insights into the normal mechanisms underpinning recall, and provides us with a framework for the study of memory dysfunction in the future."

Additional authors of the study are Chris Connor and Thomas Pieters at the UTHealth Medical School. The work was supported by the Sloan Foundation, the Hellman Foundation and the NIH.

Facebook beats expectations on strong mobile usage with $1.59B in Q4 revenue, non-GAAP EPS of $0.17

Today Facebook reported its fourth quarter financial performance, with revenues of $1.59 billion and earnings per share, on a non-GAAP basis, of $0.17.?Analysts had expected earnings per share of $0.15, not including the cost of stock-based compensation, and revenues for the period of $1.53 billion.

Quite?obviously, the company beat the street?s estimates. In its last sequential quarter, Facebook had?revenue of $1.26 billion and earnings per share of $0.12 on a non-GAAP?basis.

For the fourth quarter, GAAP net income for the firm was $64 million. And, on a GAAP basis, after taking into account stock-based compensation and other costs, Facebook earned a mere $0.03 per share.

Facebook, for the quarter, derived 23% of its advertising revenue from mobile usage. That compares favorably to its third quarter figure of 14%. The ability to monetize its mobile usage is key for the company, as its desktop usage growth slows, and smartphones become perhaps its key platform for service delivery.?That 23% of $1.33 billion in total advertising revenue of $305 in mobile ad revenue alone.

Revenue outside of advertising was all but unch, with the company noting that ?[a]djusting for the?$66 million?of revenue in the extra month of December, Payments and other fees revenue would have been essentially flat? on a year-over-year basis.

The firm?s operating margins continues to suffer. On a GAAP basis, they are down from 48% in the fourth quarter of 2011 to 33% for the most recent three month period. And on a non-GAAP basis, Facebook?s operating margin has declined from 55% to 45%, again comparing the most recent quarter to the quarter a year ago.

Following the report of its earnings, Facebook was down sharply, but has since recovered half its losses to a mere decline of 3.8%. The company has been on an impressive run lately in the public markets, moving up double digit percentage points since lows as investment banks and analysts alike have upgraded their?forecasts.

Charges dropped against 1 in Texas campus shooting

(AP) ? Prosecutors on Monday dropped charges against a 22-year-old man who authorities initially believed was involved in a shooting that wounded him and two others at a Houston-area community college.

Carlton Berry was arrested soon after the Jan. 22 shootings at Lone Star College and charged with two counts of aggravated assault with a deadly weapon.

But authorities later accused another man, Trey Foster, 22, of being the shooter. Foster has been charged with two counts of aggravated assault and faces a charge of resisting arrest in an earlier case. He was arrested Friday in the Dallas suburb of Plano.

Investigators say the shooting happened after 25-year-old Jody Neal bumped into Foster while Foster was walking with Berry. Foster and Neal argued but went their separate ways. When the two ran into each other 30 minutes later, they argued again and Foster fired at Neal, wounding him in the abdomen and leg. Authorities say at least 10 shots were fired. Berry was wounded, and a maintenance worker for the college, Bobby Cliburn, 55, was hit in the leg.

The shooting caused panic among students and led to a campus lockdown.

Prosecutor Alison Baimbridge said that in the interest of justice, authorities have dropped the charges against Berry.

"I think as with any investigation, the more work that is done, the more witnesses that are spoken with, the more evidence that is collected and tested, I think once you do all of that, you are better able to determine who was where, what actually occurred. Once you put all of that together you see the bigger picture," Baimbridge said after a court hearing in which the charges against Berry were formally dropped.

Berry's attorney, Robert A. Jones, said his client should not have been charged in the first place and should not have been jailed because the evidence showed he was a victim. Berry was shot in the left hip, which Jones said was an indication that Berry might have been facing away or running away from the shooter.

"He said that continually, whenever (authorities) talked to him, that he didn't do anything. But that wasn't enough. Then they started their investigation based upon his statement and they realized he didn't do anything," Jones said.

Berry was expected to be released from the Harris County Jail later Monday, and Jones said he just wants to go home.

Foster made his initial court appearance Monday. He is being held on bonds totaling $100,000, and if he posts them, a judge ordered him subject to GPS monitoring and a curfew.

Quanell X, a community activist who is a spokesman for Foster's family, said Foster told him Berry had nothing to do with the shooting. Berry and Foster apparently knew each other from school.

"It was inappropriate and wrong for Trey to have a pistol on campus," he said.

Quanell X said Foster legally bought the .40-caliber handgun authorities say was used in the shooting at a sporting goods store in Houston. Foster took a class for a concealed handgun license but had not completed the process to get a license, he said.

Quanell X said Foster bought the gun to defend himself after he was shot in the face a couple of years ago and had recently been receiving threats. Quanell X said Foster panicked during the shooting.

"He was very remorseful and sorry that innocent people got shot," he said.

In memoriam John Trim | CLERA blog

John TrimJohn Trim was a remarkable figure in the European language education community. He had a long and distinguished career, first?as a German scholar at UCL, then as Lecturer of Phonetics and later Director of Linguistics at Cambridge, where the Language Centre is named after him.

From the 1960s onwards, John Trim served as an advisor to the Council of Europe on learning, co-originator of the Threshold Level concept that has a huge influence on language curricula and testing, and one of the key authors?of the Common European Framework of Reference for Languages.

John was also one of the founders of BAAL. He attended first meetings in London in 1965, and was elected Treasurer at the first annual meeting at Reading in 1967, later serving as Chair from 1985 to 1988.

From 1978-1987, John served as Director of CILT, the Centre for Information on Language Teaching (1978-1987), where he played a key role in forming the Association for Language Learning. In 2012, he was awarded a Fellowship ?in recognition for his lifetime of distinguished service and outstanding achievement in the field of language learning and teaching in Europe and the UK and for his long-term contribution to the furtherance of the Association for Language Learning?. Warren Buffett made late-2012 bid for NYSE Euronext: sources

(Reuters) - Warren Buffett made a bid to acquire New York Stock Exchange operator NYSE Euronext last November, but his offer was less than one already on the table from IntercontinentalExchange Inc , two people familiar with the matter said.

The sources, speaking on condition of anonymity because they were not authorized to discuss the matter publicly, said Buffett's conglomerate Berkshire Hathaway was the "Company A" bidder disclosed in a regulatory filing by ICE on Monday.

Buffett's assistant could not immediately comment on the report. NYSE Euronext declined to comment. The news was first reported by CNBC's David Faber.

ICE agreed to buy NYSE Euronext late last month for $8.2 billion following about two months of talks.

Before the deal closed, NYSE's board of directors instructed the company's bankers to pursue alternatives, according to the ICE filing with the U.S. Securities and Exchange Commission.

Bankers from Perella Weinberg approached "Company A" on November 25, the filing said. On November 28, "Company A" presented an offer that was less than the ICE bid and was conditioned on the sale of NYSE Euronext's European derivatives business for a minimum price.

At a NYSE board meeting December 12 and 13, Perella Weinberg indicated that it was still working with "Company A" but that the bidder had not improved the offer. There was no further mention of the unnamed bidder in the filing.

Had Berkshire done the deal, it would have been somewhat small by Buffett's standards. He spent much of 2012 trying to do deals in the $20 billion range, and even said at one point that he might have to look at doing a $30 billion deal this year.

As you can see, this was a very, very short duel, mainly because it is just to illustrate the workings (and I was dueling myself...) I think the basic system is pretty easy to understand - Changes in LP are always bold, the turn markings are bold, and names of cards in italics. Syrian Islamist rebels detonate car bomb near Israel border

BEIRUT (Reuters) - Eight members of Syria's military intelligence were killed by an Islamist militant car bomb on Thursday night near the southern frontier with the Israeli-occupied Golan Heights, opposition activists and a violence monitoring group said on Friday.

The Syrian Observatory for Human Rights said the bomb was planted by Al-Nusra Front, a rebel unit fighting to oust President Bashar al-Assad that the United States has labeled a terrorist group.

"We think the blast might have killed a colonel who has been leading the fight against rebels in the area," Rami Abdelrahman, head of the Britain-based Observatory said. The building targeted is in the town of Saasa, 14 miles from the frontier with the Golan Heights, he said.

He added that death toll was likely to rise as several security personnel were in a critical condition.

Syrian rebels have been battling Assad's army for months in towns inside and adjacent to the Area of Separation between Israel and Syria, along the disengagement line from the 1973 war.

State-run Israel Radio aired what it said was an interview with an unnamed man from Saasa saying the explosion was close to Israel. "I heard an explosion. I did not see it, I heard it. It was a very large explosion," he said.

This week I received a deviation on an scam that has been around for years ? your package was returned and click this link to get it.? I also received one that my LogMein SSL Certificate had been suspended?- click here to fix.?Of course, the links are malicious and at least, would come with some irritating pop-ups and at worse, steal your identity, seize your system and ruin your computer.

These exploits are designed to cause an immediate emotional response that will make you click before your think.? Because if you look closer, the fraud is apparent.? The?mail and parcel carriers do not typically?use email for package routing information?although some will let you elect mobile or email notification.? The body of the emails usually have?spelling or grammatical errors and often the links take you to strange sites. A?suspended LogMein SSL Certificate is a problem, but too suspicious to believe the email.

If you think the issue may be real, do some additional research but don?t click any links. Even with legitimate emails, your clicks are tracked by?embedded links.? So if you don?t want to be tracked or scammed, avoid links.

You already know these tips for protecting yourself, but let?s review:

1. Have a good Spam Filter.? Still about 90% of the emails sent worldwide are Spam and many are malicious. A good filter will catch most Spam.

2. Use virus protection.? Even if you use a great Spam Filter, you still need virus protection for those threats that slip through. We like Symantec for our business users.

3. Use malware protection. There are several that you can try and use free for home use. We like MalwareBytes and Advanced System Care. The licensed versions provide real-time protection.

4. Do not open files or click links in emails unless you trust and know the source.??And even if you know and trust the source be sure it is a?real email from them. Email accounts can be hacked and?malicious emails sent from?your friend?s account.

5.? If you think you are infected, consult an expert.? If it looks really bad, disconnect your computer from the network or Internet. If it looks really, really bad, turn off your computer until help is available.

6. Don?t put your credit card information in those pop-ups that guarantee to remove the infection, they are scams.

7.?Don?t forward email unless absolutely necessary.? This is not only for security but for proper etiquette as well.? If you have to forward something be sure it is not a hoax and that the recipient wants to receive. If you have to send that funny joke, be sure to have the recipient?s permission.

We look at online threats constantly, but sometimes there is one so good that even the experts are initially fooled.

ROCKLAND, Maine (AP) ? "American Pie" singer Don McLean has been fined $400 for driving his Chrysler too fast through a Maine school zone.

McLean's lawyer says he was driving 43 mph in an area that has a limit of 15 mph when school zone warning lights are flashing and 45 mph when they're not. He argued that the lights were off, but police said in Rockland District Court on Thursday that they were on.

A judge lowered the fine from $515 to $400, and McLean immediately paid up.

McLean lives in nearby Camden, along Maine's coast. He burst into popularity in 1971 with his hit "American Pie," about the deaths of Buddy Holly, Ritchie Valens and the Big Bopper in a plane crash on Feb. 3, 1959 ? The Day the Music Died.

While RIM throws checks at developers, and Steve Ballmer invades other people's press conferences to shout about apps, the folks behind the Ubuntu smartphone project are taking a very different tack. According to Richard Collins, product manager at Canonical, the first device -- expected by early next year -- will target basic users and only run pre-installed software:

"In terms of our first go-to-market product strategy, the intention is not to have an application store full of ready-made applications that are there to download. We have a very definite approach in terms of addressing a very important part of the market where users are primarily interested in being able to use a core set of applications."

Let's be clear, though: this entry-level phone will be capable of accessing a storefront for third-party apps at some point in the future. A huge part of Canonical's long-term plan is to capitalize on its relationships with developers and the fact that existing Ubuntu desktop apps should be relatively easy to port to the new breed of phones and tablets. When Tomy rep, Jamie Kieffer, took out the Battroborgs we were immediately struck by how small they were. Maybe previous coverage didn't give us proper perspective, but at about two or three inches tall, they're damn-near pocketable, which was a tad unexpected. In fact, if we think they were a precursor to our Real Steel fantasies coming true, we'd say they were cute. Their exceptionally light plastic bodies have two arms with joints at the elbow and shoulder, which allow them to throw straight rights and jabs. We also discovered, accidentally, that if you pop the elbow joint out of place you can "teach" the little guys to throw a hook. The controller bears obvious similarities to the Wii controller and Nunchuk. Two white plastic parts are connected by a thin cord with the larger half housing four AA batteries and an on off switch. Both pieces house accelerometers that translate your furious flurries into robot rights and lefts.

Operation is pretty simple. A small connector on the front of the controller lets you dock a robot and charge it for up to 20 minutes of continuous combat. When its time to do battle you flick a tiny switch on the back of your Battroborg then turn on the controller (in that order, please) to pair the two using 2.4GHz wireless. Communication between the two is instantaneous and, even with four slugging it out simultaneously, there seemed to be no interference from the devices. In fact, TOMY claims you can have up to 20 of them slug it out simultaneously. While the punching controls are pretty self explanatory, moving about takes some adjustment. Since a single motor drives the whole bot, moving forward is accomplished through throwing a series of alternating punches. (Throwing one punch over and over will spin you in a circle.)

Battroborgs should be hitting American retailers in time Christmas, with two bots and an arena expected to cost between $70 and $80. While additional combatants can be purchased separately for around $30.

Space instrument adds big piece to solar corona puzzle

Jan. 23, 2013 ? The Sun's visible surface, or photosphere, is 10,000 degrees Fahrenheit. As you move outward from it, you pass through a tenuous layer of hot, ionized gas or plasma called the corona. The corona is familiar to anyone who has seen a total solar eclipse, since it glimmers ghostly white around the hidden Sun.

But how can the solar atmosphere get hotter, rather than colder, the farther you go from the Sun's surface? This mystery has puzzled solar astronomers for decades. A suborbital rocket mission that launched in July 2012 has just provided a major piece of the puzzle.

The High-resolution Coronal Imager, or Hi-C, revealed one of the mechanisms that pumps energy into the corona, heating it to temperatures up to 7 million degrees F. The secret is a complex process known as magnetic reconnection.

"This is the first time we've had images at high enough resolution to directly observe magnetic reconnection," explained Smithsonian astronomer Leon Golub (Harvard-Smithsonian Center for Astrophysics). "We can see details in the corona five times finer than any other instrument."

"Our team developed an exceptional instrument capable of revolutionary image resolution of the solar atmosphere. Due to the level of activity, we were able to clearly focus on an active sunspot, thereby obtaining some remarkable images," said heliophysicist Jonathan Cirtain (Marshall Space Flight Center).

Magnetic braids and loops

The Sun's activity, including solar flares and plasma eruptions, is powered by magnetic fields. Most people are familiar with the simple bar magnet, and how you can sprinkle iron filings around one to see its field looping from one end to the other. The Sun is much more complicated.

The Sun's surface is like a collection of thousand-mile-long magnets scattered around after bubbling up from inside the Sun. Magnetic fields poke out of one spot and loop around to another spot. Plasma flows along those fields, outlining them with glowing threads.

The images from Hi-C showed interweaved magnetic fields that were braided just like hair. When those braids relax and straighten, they release energy. Hi-C witnessed one such event during its flight.

It also detected an area where magnetic field lines crossed in an X, then straightened out as the fields reconnected. Minutes later, that spot erupted with a mini solar flare.

Hi-C showed that the Sun is dynamic, with magnetic fields constantly warping, twisting, and colliding in bursts of energy. Added together, those energy bursts can boost the temperature of the corona to 7 million degrees F when the Sun is particularly active.

Selecting the target

The telescope aboard Hi-C provided a resolution of 0.2 arcseconds -- about the size of a dime seen from 10 miles away. That allowed astronomers to tease out details just 100 miles in size. (For comparison, the Sun is 865,000 miles in diameter.)

Hi-C photographed the Sun in ultraviolet light at a wavelength of 19.3 nanometers -- 25 times shorter than wavelengths of visible light. That wavelength is blocked by Earth's atmosphere, so to observe it astronomers had to get above the atmosphere. The rocket's suborbital flight allowed Hi-C to collect data for just over 5 minutes before returning to Earth.

Hi-C could only view a portion of the Sun, so the team had to point it carefully. And since the Sun changes hourly, they had to select their target at the last minute -- the day of the launch. They chose a region that promised to be particularly active.

"We looked at one of the largest and most complicated active regions I've ever seen on the Sun," said Golub. "We hoped that we would see something really new, and we weren't disappointed."

Next steps

Golub said that data from Hi-C continues to be analyzed for more insights. Researchers are hunting areas where other energy release processes were occurring.

In the future, the scientists hope to launch a satellite that could observe the Sun continuously at the same level of sharp detail.

"We learned so much in just five minutes. Imagine what we could learn by watching the Sun 24/7 with this telescope," said Golub.

This research is being published in the journal Nature in a paper co-authored by Cirtain, Golub, A. Winebarger (Marshall), B. De Pontieu (Lockheed Martin), K.
